What this letter does

An Arizona HOA records request letter asks the association to make its financial and other records available to a member under A.R.S. section 33-1805. A written request starts the 10-business-day period and gives you a clear record if the association delays.

Key rules in A.R.S. 33-1805

  • Who can ask. Members, or representatives they designate in writing, can examine records that are reasonably available for examination.
  • No fee to review. The statute says no fee may be charged for making records available for review.
  • 10 business days. The association must fulfil requests to examine records, and requests for copies, within 10 business days.
  • Copy fee limit. Not more than $0.15 per page.
  • No stated purpose. The text does not require a member to state a purpose.

Records that may be withheld

The statute lets the association withhold privileged communications between the association and its attorney, records related to pending litigation, minutes or records of board sessions not required to be open to all members, personal, health or financial records of an individual member, employee or contractor's employee, and records on an individual employee's job performance, compensation, health or specific complaints. It also does not require disclosure that would violate state or federal law.

How to use the letter

  1. Describe each record and give date ranges.
  2. Send the letter in a way you can prove, such as email with a read receipt or certified mail.
  3. Count 10 business days from receipt.
  4. If the association misses the deadline or withholds records without explanation, send a follow-up letter. Section 33-1805 lists no specific penalty, so ask an Arizona attorney or the state's available dispute processes about your options.

For other states, see the general letter to the HOA requesting documents. Statutes change, so confirm the current text of section 33-1805 on the Arizona Legislature's website.

For a sale, the Arizona HOA resale disclosure is requested separately. If the association refuses or the records show a wrong charge, an HOA dispute letter is the next step.
