Re: Variance request, [Property Address]

Dear Board of Directors,

I request a variance from [Rule Citation], which provides that [Rule Summary]. I would like to [Requested Exception, for example "build a 7-foot fence where the limit is 6 feet" or "install a shed 3 feet from the lot line"].

Reason: [Variance Reason, for example "the lot slopes steeply and a standard fence would not provide privacy, or a disability requires X"].

How I will limit the impact: [Mitigation, for example "the fence will match approved colors and be set back from the street"]. I have shared the plan with neighbors [Neighbor Names], who [Neighbor Response].

I enclose drawings, photographs and [Other Attachments]. I would appreciate a decision by [Decision Date], and I am happy to attend a board meeting. I can be reached at [Owner Phone] or [Owner Email].

Sincerely,

What this letter does

A variance request asks the board to allow a one-time departure from a rule because of the property or the owner's circumstances. The board is not required to grant it unless the documents or law say so.

What strengthens a request

  • A specific rule and a specific exception.
  • A real reason tied to the lot or a need.
  • Steps to reduce the effect on neighbors.
  • Neighbor support, in writing if possible.
  • Drawings and photos.

Typical variance requests involve a shed, a pool or a tree that falls outside a rule, and a request often follows an HOA violation letter for work that does not meet the rules.

Variance vs accommodation

If the request relates to a disability, it may be a reasonable accommodation under fair housing law rather than a variance, which carries stronger obligations. See the assistance animal request as an example.

After the decision

Approvals use the variance approval letter. Refusals use the denial letter, and the owner may appeal. Projects often start with an architectural request or a fence request.

Common questions

Does a variance set a precedent?

It can. Boards often state that it applies to this property only.

Can a variance be conditional?

Yes. Conditions are common.

This page gives general information and sample wording. It is not legal advice, and requirements differ by state and by association.
